These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the “website”) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).
These pages, the content and infrastructure of these pages, and the online accommodations reservation service provided on these pages and through the website (the “service”) are owned, operated and provided by NamaaStay.com and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.
Scope of our Service
Through the website, we (NamaaStay.com and its affiliate (distribution) partners) provide an online platform through which all types of temporary accommodations (for example hotels, motels, hostels and bed & breakfasts, collectively the “accommodation(s)”), can advertise their rooms for reservation, and through which visitors to the website can make such reservations. By making a reservation through NamaaStay.com, you enter into a direct (legally binding) contractual relationship with the accommodation provider at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the provider, transmitting the details of your reservation to the relevant accommodation provider and sending you a confirmation email for and on behalf of the accommodation provider.
If you are renting a property, we suggest you always check your rental agreement and secure your landlord’s permission if required. You need to ensure your home insurance policy covers accommodating short-term guests within your home.
When rendering our services, the information that we disclose is based on the information provided to us by accommodation providers. As such, the accommodation providers are given access to an extranet through which they are fully responsible for updating all rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each accommodation provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website.
THE SITE, APPLICATION AND SERVICES COMPRISE AN ONLINE PLATFORM THROUGH WHICH HOSTS MAY CREATE LISTINGS FOR ACCOMMODATIONS AND GUESTS MAY LEARN ABOUT AND BOOK ACCOMMODATIONS DIRECTLY WITH THE HOSTS. YOU UNDERSTAND AND AGREE THAT NAMAASTAY IS NOT A PARTY TO ANY AGREEMENTS ENTERED INTO BETWEEN HOSTS AND GUESTS, NOR IS NAMAASTAY A REAL ESTATE BROKER, AGENT OR INSURER. NAMAASTAY HAS NO CONTROL OVER THE CONDUCT OF HOSTS, GUESTS AND OTHER USERS OF THE SITE, APPLICATION AND SERVICES OR ANY ACCOMMODATIONS, AND DISCLAIMS ALL LIABILITY IN THIS REGARD TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Booking and Financial Terms
“Accommodation Fees” means the amounts that are due and payable by a Guest in exchange for that Guest’s stay in an Accommodation. The Host alone, and not NamaaStay, is responsible for the Accommodation Fees for his or her Listing. The Host may in his or her sole discretion decide to include in these amounts (i) a cleaning fee or any other fee permitted on the NamaaStay platform, or (ii) Taxes that the Host determines that he or she has to collect.
“Booking Fees” means the fee that NamaaStay charges a Guest for the use of the Services, which is calculated as a percentage of the applicable Accommodation Fees. The Booking Fees will be displayed to the Guest when the Guest is asked whether to send a booking request to a Host.
“Total Fees” means collectively the Accommodation Fees and the Booking Fees plus any Taxes.
“Servicing Fees” refers to the fee that gets assessed for payment processing, which is calculated as a percent of “Total Fees”.
Cancellation of Booking
By making your booking, our agreement is a legal contract and you agree to our terms and conditions. At the time of booking we charge you the entire amount for the stay, 10% of which is a non-refundable booking fee. If you cancel your reservation within the first 72 hours of your booking, the entire amount paid for your stay will be refunded except the 10% non-refundable booking fee, within a commercially reasonable time. If you cancel after 72 hours, there will be a 50% cancellation fee of the amount due for the stay until 24 hours prior to your check-in time. There will be no refunds issued for same day cancellations or no shows. If the host cancels the booking for any unforeseen reason(s) the entire amount will be refunded to the guest including the booking fee.
Payment & Deposit
Reservations made will be required to pay the entire amount due for the stay including a 10% non-refundable booking fee. The appropriate amount will automatically be charged to the credit card provided or can be transferred into our bank account directly. Any booking not deposited with us by this time will automatically cancel without notification. If the host has requested a security deposit, at the time of booking we will charge the card on file as a security deposit. If there are no claims against the security deposit within 24 hours after check out, the entire amount is refunded back to the guest within 5 to 7 business days since check-out. If there are any damages, the refund amount will be adjusted. NamaaStay, is not responsible for administering or accepting any claims by Hosts related to Security Deposits, and disclaims any and all liability in this regard. All credit card transactions are secure and no data collected is offered to third parties for any reason.
Damages and Breakages
Please take care when staying in our home. You are responsible and liable for any breakages or damages which you cause to the accommodation or its contents. We ask is that you do report any incidents when they occur.
We do not accept any liability for any damage, loss or injury to any member of your party or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves or our employees or contractors whilst acting in the course of employment.
Any data collected during the course of this booking will be stored on our computer(s). With your permission we may from time to time contact you about promotions and offers. We will not share your details with any third party.
Your State Law
Some cities have laws that restrict your ability to host paying guests for short periods. These laws are often part of a city’s zoning or administrative codes. In many cities, you must register, get a permit, or obtain a license before you list your property or accept guests. Certain types of short-term bookings may be prohibited altogether. Local governments vary greatly in how they enforce these laws. Penalties may include fines or other enforcement. Please review your local laws before listing your space.
By completing a booking, you agree to receive an email which we may send you shortly prior to your arrival date, giving you information on your destination and providing you with certain information and offers (including third party offers to the extent that you have actively opted in for this information) relevant to your reservation and destination, and (ii) an email which we may send to you promptly after your stay inviting you to complete our guest survey form. Intellectual Property Rights
Unless stated otherwise, the software required for our services or available on or used by our website and the intellectual property rights (including the copyrights) of the contents and information of and material on our website are owned by NamaaStay.com, its suppliers or providers.
The online accommodation reservation service is rendered by NamaaStay.com, which is a private limited liability company, incorporated under the laws of the state of Ohio and having its offices in Cleveland, Ohio.
